What is a night shift?

Night shift is work performed during the night period, between 10pm and 6am. Workers who perform more than 3 hours in this period are considered night workers.

Definition of night work

Night work is specifically regulated due to its effects on worker health and safety. Labor law defines two concepts: the night period (10pm-6am) and the night worker (someone who regularly works at least 3 hours in this period or one-third of their annual hours).

Labor law establishes special rules:

  • Night workers' shifts cannot exceed 8 hours daily on average over a 15-day period
  • They cannot perform overtime except in exceptional cases
  • They must receive free health assessments
  • Night work has specific compensation (night premium) unless the salary already accounts for it
  • Prohibited for workers under 18
