How many hours of rest are required between shifts?

Rest between shifts is the minimum period of 12 consecutive hours of rest that must exist between the end of one workday and the start of the next, according to labor law.

Inter-shift rest

Rest between shifts or inter-shift rest is a mandatory recovery period established to protect worker health and safety. This time allows for necessary physical and mental rest between work periods, being especially important in rotating or night shift work.

12h
Standard minimum rest
Between the end of one shift and the start of the next
12h+
After night shift
Some agreements require longer rest (up to 24h)

Regulations on rest between shifts

Labor law establishes the following rules:

  • Minimum of 12 hours between the end of one shift and the start of the next
  • It's a legal minimum that collective agreements can extend
  • Cannot be reduced or financially compensated
  • Applies to all workers regardless of contract type
  • After night shifts, some agreements require 24-48 hours rest

Practical examples

Let's look at some cases to understand when rest requirements are met:

Invalid Afternoon shift (2pm-10pm) to Morning shift next day (8am-4pm) = 10 hours rest
Valid Afternoon shift (2pm-10pm) to Afternoon shift next day (2pm-10pm) = 16 hours rest
Invalid Night shift (10pm-6am) to Afternoon shift same day (2pm-10pm) = 8 hours rest

How Qadra ensures rest between shifts

Qadra automates inter-shift rest validation:

  • Automatic validation of minimum 12 hours between shifts
  • Custom configuration by shift type (normal, night)

Frequently asked questions about rest between shifts

Can the 12-hour rest be reduced in any case?

Generally no, but there's an exception in shift work activities when the worker changes teams and cannot enjoy inter-shift rest. In these cases, equivalent rest must be compensated.

What happens if the employer doesn't respect the 12 hours?

It constitutes a serious violation sanctionable by labor inspection. The worker has the right to refuse to work without it being considered job abandonment, and can claim damages.

Does on-call time count as rest?

No. On-call or standby periods are not considered effective rest, even if the worker is at home. Rest must be complete and uninterrupted.
